Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Constant Employee service ("Service") operated by Zillion Research Labs, Inc. (doing business as Constant Employee; "we," "us," or "our"). By signing up for the Service, you agree to these Terms.
1. The Service
Constant Employee provides an AI phone receptionist that answers calls placed to a phone number we provision for your business, triages emergencies, books appointments, and sends confirmations on your behalf.
2. Eligibility
You must be at least 18 years old and authorized to bind the business you represent. The Service is currently available to residential trade contractors operating within the United States.
3. Your account
You are responsible for the accuracy of the information you provide during signup and for safeguarding your account credentials. You must notify us immediately of any unauthorized access.
4. Pricing and billing
The Service is billed by Stripe at the plan rates posted at constantemployee.com/#pricing at the time of subscription (currently: $297/month for Lite or $397/month for Pro, plus a one-time setup fee). Subscriptions auto-renew monthly until cancelled. Add-on packages and overage charges are billed at the rates posted on the Site at the time of purchase or incurrence.
Charges on your statement will appear as CONSTANTEMPLOYEE or ZILLION RESEARCH.
5. Cancellation and refunds
You may cancel at any time from your dashboard or by emailing us. Cancellation takes effect at the end of the current billing period. Monthly fees already paid are non-refundable. The one-time setup fee is non-refundable once your dedicated phone number has been provisioned.
6. Your responsibilities
- You are responsible for the accuracy of the business information, service area, and pricing represented to callers through the AI agent.
- You must respond to emergency escalations and booking confirmations promptly. The Service does not dispatch field technicians on your behalf.
- You may not use the Service to make unsolicited marketing calls or send unsolicited messages.
- You agree not to attempt to reverse-engineer the Service, abuse the underlying AI models, or circumvent rate limits.
7. Calls and recordings
Calls answered by the Service are recorded and transcribed for your operational use, quality assurance, and to populate your dashboard. You are responsible for ensuring callers are notified of recording where required by state law (single-party-consent states vs. two-party-consent states). The standard agent greeting can be configured to include a recording disclosure on request.
8. SMS and email confirmations
The Service sends SMS and email confirmations to callers who explicitly opt in during the call. SMS is delivered through our shared sending infrastructure registered with the carriers under the Constant Employee brand. See our SMS Terms for details.
9. Service availability
We target high availability but do not guarantee uninterrupted service. Outages may occur from upstream providers (carrier, AI model, cloud hosting). We will not be liable for missed calls or bookings caused by force-majeure events or third-party outages outside our reasonable control.
10. Intellectual property
The Service, software, content, and trademarks are owned by Zillion Research Labs, Inc. or its licensors. You receive a non-exclusive, non-transferable right to use the Service for the duration of your subscription. Your business data (customers, bookings, recordings) remains yours; we act as a processor.
11. Disclaimer of warranties
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. The AI agent may make mistakes; you are responsible for reviewing bookings and following up on flagged calls.
12. Limitation of liability
To the maximum extent permitted by law, Zillion Research Labs, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost bookings, or damage to business reputation. Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid us in the 12 months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Zillion Research Labs, Inc. and its officers, employees, and agents from any claim or demand arising out of your use of the Service in violation of these Terms or applicable law, including any claim by a caller, customer, or third party related to the work you perform for them.
14. Termination
We may suspend or terminate your account for non-payment, violation of these Terms, fraudulent or abusive use of the Service, or as required by law. On termination, your dedicated phone number, dashboard access, and AI agent will be deactivated; data may be retained as described in our Privacy Policy.
15. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to active contractors by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
